PARTICIPATION IN THE COMPETITION

Participation in competitions organised by LOWA Sportschuhe GmbH, Hauptstr. 19, 85305 Jetzendorf, Germany (hereinafter referred to as the organiser) is free of charge and is exclusively governed by these terms and conditions of participation. The terms and conditions of participation also include data protection notices for participants.

CONDITIONS FOR PARTICIPATION

The prerequisite for participating in the competition "LOWA x Strava Tame240 Challenge" (hereinafter referred to as "competition") is the completion of the challenge on Strava, the receipt of the digital finisher badge, and successful registration for participation at https://newsletter.lowa.com/registration-strava including confirmation.

Participation in the competition requires acceptance of the General Terms and Conditions of LOWA Sportschuhe GmbH, which can be accessed via the following link: https://lowa.com/de/allgemeine-geschaftsbedingungen.

"Content" within the meaning of these terms and conditions of participation includes all content and information uploaded, entered, or otherwise communicated by participants in connection with the competition, such as photos, graphics, videos, texts, comments, or information about locations and people.

ELIGIBLE PARTICIPANTS

Eligible to participate are natural persons residing in Europe*, who have reached the age of 18. Participation is not limited to customers of the organiser and is not dependent on the purchase of a product or service. Employees of the organiser and its affiliated companies, as well as their family members, are not eligible to participate in the competition. The organiser reserves the right to exclude persons from participation at its own discretion if there are justified reasons, for example, a) in the case of manipulations in connection with the implementation of the competition, b) in the case of violations of these terms and conditions of participation, c) in the case of false or misleading information in connection with participation in the competition.

PARTICIPATION

All submissions received on time and fully completed will participate in the competition.

Participation in the competition takes place by registering at https://newsletter.lowa.com/registration-strava. By submitting the form, the participant accepts the terms and conditions of participation. Participation is only possible until the closing date.

Competition Period: 1 April 2025 to 30 April 2025

Closing Date for Participation: Wednesday, 30 April 2025 at 23:59

The winner(s) of the draw will be notified by the organiser via email within one week after the closing date. If the winner does not respond within one week of the notification, the organiser is entitled to determine a new winner. The prize will be handed over exclusively to the winner. An exchange or cash payment of the prize is not possible. The prize confirmation with all detailed information will be sent to the winner by email. The winner is responsible for any taxes on the prize.

The following prize will be drawn 12 times:

12x one (1) pair of LOWA trail running shoes, model AMPLUX 2 or MADRIX, will be drawn.

The winner has the option to choose between the mentioned models after being notified of the win.

The winner will be determined after the closing date in a random draw among all participants. Legal recourse regarding the drawing of the winners is excluded.

The prize can be changed, interrupted, or cancelled by the organiser at any time if there are valid reasons (e.g., illness, danger to life and limb, or other reasons).

LOWA is only liable for intent and gross negligence. This does not apply in the case of negligent violation of an essential contractual obligation. These are obligations that are essential for the implementation of the competition, as they make it possible in the first place, and on whose fulfilment the participant can therefore rely. In this case, LOWA's liability for simple negligence is limited to the typical and foreseeable damage for the competition. The above limitations of liability do not apply in the event of injury to life, body, and health, for a defect after the assumption of a guarantee for the quality of a product, and in the case of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.

To the extent that our liability is excluded or limited, this also applies to the personal liability of our employees, representatives, and vicarious agents, as well as to the liability of the sponsor(s). In the case of grossly negligent breach of duty by our vicarious agents, the above limitations apply to the slightly negligent breach of essential obligations.

TERMINATION OF THE COMPETITION

The organiser expressly reserves the right to interrupt or terminate the competition at any time without prior notice and without giving reasons and to adjust these terms and conditions of participation. This applies in particular due to external circumstances and constraints, which include technical problems, legal changes, or mandatory measures by third parties that are beyond our control.

DATA PROTECTION

To participate in the competition, it is necessary to provide personal data. The participant assures that the information provided about their person, in particular first name, last name, country, and email address, is truthful and correct.

The personal data of the participants will not be passed on to third parties or made available to them for use without consent.

The personal data of the participants will be used by LOWA Sportschuhe GmbH for the following marketing purposes until the participant revokes their consent (see Revocation):

Sending the LOWA newsletter with information about products, sales promotions, and services, as well as other LOWA and product-related topics, and its analysis through individual measurement, storage, and evaluation of opening rates and click rates in recipient profiles for the purpose of designing future newsletters.

Use of the data to create personalised emails tailored to the interests and behaviour of the recipients.

Segmentation of the target group based on demographic information, purchasing behaviour, or interests to enable more targeted marketing measures.

Analysis of customer behaviour by evaluating opening and click rates as well as other interactions.

Conducting remarketing campaigns to display interest-based, targeted advertising to people who have already shown interest in our products or services.

Optimisation of marketing content by measuring effectiveness and gaining insights into the preferences and behaviour of the target group.

Use of the data for cross-device tracking to track user behaviour across different devices and ensure a consistent marketing message.

In the event of a win, the winner agrees to the publication of their name in the advertising media used by the organiser. This includes the announcement of the winner on the organiser's website and social media platforms.

The legal basis for processing is Art. 6 para. 1 sentence 1 lit. b GDPR, insofar as the processing is necessary for the provision, implementation, and handling of the competition. In the case of the participant's consent to the processing, the legal basis is Art. 6 para. 1 sentence 1 lit. a GDPR. Processing is carried out in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, insofar as it serves our legitimate interests in the security of the competition or the protection of our interests against misuse.

The participant can obtain information about the data stored about them at any time, object to the use of their data, and request its deletion. A simple letter to LOWA Sportschuhe GmbH, Hauptstr. 19, 85305 Jetzendorf, Germany, or an email to datenschutz@lowa.de is sufficient. After revocation of consent, the collected and stored personal data of the participant will be deleted immediately. Further regulations on the handling of personal data can be found in the organiser's privacy policy at https://lowa.com/en/duty-to-inform.

REVOCATION

The participant can revoke their consent to data storage at any time. This can be done at any time in written form via https://newsletter.lowa.com/update-preferences.

Facebook wedstrijd

DEELNAMEVOORWAARDEN:

Deelname staat open voor personen die woonachtig zijn in de DACH-regio. Medewerkers van LOWA Sportschuhe GmbH of haar dochterondernemingen, hun familieleden en alle personen die betrokken zijn bij de totstandkoming van deze wedstrijd zijn uitgesloten van deelname. Alleen deelnemers met Facebook-accounts die een persoon met de juiste naam vertegenwoordigen, zijn toegestaan. Deelname met valse identiteiten of identiteiten van derden is niet toegestaan.

Deelname staat los van het gebruik van diensten. Het gebruik van de door de organisator aangeboden diensten of het abonneren op de nieuwsbrief vergroot de winkans niet. Door het uploaden van een foto of video verklaart elke deelnemer dat hij/zij alle bestaande rechten bezit op de foto of video die hij/zij heeft geüpload en dat hij/zij geen rechten van derden schendt door zijn/haar foto op Facebook te publiceren. Dit omvat in het bijzonder auteursrechten van derden of persoonlijke rechten van gefotografeerde personen. De deelnemer vrijwaart de organisator tegen aanspraken van derden die voortvloeien uit de schending van dergelijke rechten en de kosten van juridische stappen. De foto's of video's mogen geen inbreuk maken op de persoonlijke rechten van derden. Voor namen of afbeeldingen van derden is hun schriftelijke toestemming nodig. Door het uploaden van de video geeft de deelnemer LOWA toestemming om het geüploade materiaal te gebruiken op LOWA websites, blogs en social media kanalen.

De organisator is niet verantwoordelijk voor het gedrag van de deelnemers en de inhoud die door de deelnemers wordt gepubliceerd als onderdeel van de wedstrijd (foto's, begeleidende teksten, begeleidende informatie over personen, enz. Bovendien is de organisator niet verplicht om dergelijke inhoud te controleren, maar behoudt zich het recht voor om de publicatie ervan in te trekken en van de wedstrijd uit te sluiten als er concrete aanwijzingen zijn dat de inhoud in strijd is met wettelijke vereisten, officiële verboden, rechten van derden of de goede zeden.

Deelname vindt plaats via Instagram door de post van LOWA te liken, het LOWA-kanaal op Instagram te volgen, het Ultratrail Franconian Switzerland-kanaal op Instagram te volgen en een opmerking achter te laten over de afstand die hij/zij zou willen lopen op de Ultratrail Franconian Switzerland.

Alleen als aan alle voorwaarden is voldaan (volgen, liken en reageren) doe je mee aan de loting. De winnaars worden binnen 2 werkdagen na afloop van de inschrijfperiode bekendgemaakt via een opmerking in de commentaarkolom van het wedstrijdbericht. De winnaars zijn vervolgens verplicht om hun volledige naam en adres naar lowa.outdoor Instagram te sturen via een privébericht of per e-mail naar communication@lowa.de om de prijs te claimen en de verzending van de prijs in gang te zetten. Als het adres niet voor 02.02.2025, 12:00 uur naar LOWA Sportschuhe GmbH is verzonden, vervalt de prijs.

Prijs:

2x trail running pakket, elk met een startcode voor de ultra trail race (afstand naar keuze) en een paar van onze momenteel beschikbare TRAILRUNNING modellen.

Andere en extra kosten zoals reis- of verblijfskosten etc. zijn niet inbegrepen.

AANSPRAAK MAKEN OP DE PRIJZEN:

Betaling van de prijs is niet mogelijk.

(Voor niet-contante prijzen: De prijs wordt per post naar de winnaar gestuurd. Het door de winnaar opgegeven adres wordt gebruikt om de prijs te versturen. De winnaar moet ervoor zorgen dat het adres correct is. LOWA Sportschuhe GmbH is niet aansprakelijk voor onbestelbare pakketten/brieven als gevolg van een onjuist adres dat door de winnaar is opgegeven)

ANNULERINGSOPTIE:

De organisator behoudt zich het recht voor om de wedstrijd op elk moment zonder opgaaf van redenen op te schorten, voortijdig te beëindigen of te annuleren. Dit recht wordt met name uitgeoefend als de goede organisatie van de wedstrijd om technische of juridische redenen niet kan worden gegarandeerd.

CONTROLLER:

De wedstrijd wordt niet ondersteund door Instagram en is op geen enkele manier verbonden met Instagram en wordt op geen enkele manier gesponsord, ondersteund of georganiseerd door Instagram. Vragen, opmerkingen of klachten over de wedstrijd moeten worden gericht aan het adres van LOWA Sportschuhe GmbH.

WETTELIJK:

Juridisch verhaal is uitgesloten met betrekking tot de trekking van de winnaars en de beoordeling van de inhoud van de ingediende wedstrijdinzendingen.

GEGEVENSBESCHERMING:

Door deel te nemen gaat de deelnemer ermee akkoord dat zijn/haar ingezonden gegevens uitsluitend worden opgeslagen ten behoeve van de organisatie van de wedstrijd. De gegevens worden na afloop van de wedstrijd gewist. Persoonlijke gegevens worden niet opgeslagen voor commerciële doeleinden. Ze worden niet doorgegeven aan derden. Alle doorgegeven informatie is onderhevig aan de gegevensbeschermingsregels van de organisator.

Deelnemers stemmen ermee in dat hun foto's en namen openbaar worden gemaakt aan derden in verband met de wedstrijd, de selectie van winnaars, verwerking of presentatie van inzendingen door de organisator of door derden in opdracht van de organisator in het online gedeelte (bijv. op de Facebook-pagina of website) en in gedrukte vorm (en in deze context in het bijzonder kunnen worden gereproduceerd, gedistribueerd en openbaar toegankelijk gemaakt door de organisator en derden in opdracht van de organisator).

Toepasselijk recht:

Op de wedstrijd is uitsluitend Duits recht van toepassing, voor zover dit niet in strijd is met dwingende consumentenbeschermingsvoorschriften, die in dit geval geldig blijven.
