DUTY TO PROVIDE INFORMATION - DSGVO

The protection of your personal data is of particular concern to us. We therefore process your data exclusively on the basis of the statutory provisions that authorise or oblige us to process data, or you have given us your express consent to do so. The following data protection information covers both the current legal framework under the Federal Data Protection Act (BDSG) or the Telemedia Act (TMG), as well as the provisions of the EU General Data Protection Regulation (GDPR) valid from 25 May 2018. The legal basis of the GDPR will apply from 25 May 2018.

In this data protection information, we inform you about the most important aspects of data processing.

As the controller, LOWA Sportschuhe GmbH is obliged to inform data subjects about certain factual and legal circumstances relating to data protection. This information is intended to enable data subjects to gain knowledge of the scope and processing of their data. Under no circumstances do we sell your data or pass it on to third parties outside the LOWA Sportschuhe group of companies.

The obligation to provide information exists in accordance with Art. 13 of the General Data Protection Regulation (GDPR) and applies to data processing by LOWA Sportschuhe GmbH.

Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.

Consent Art. 6 para. 1 lit. a) GDPR
The data subject has given consent to the processing of their personal data for one or more specific purposes.

Legitimate interest Art. 6 para. 1 lit. f) GDPR
Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

d) Recipient of the data
Your data is processed by employees who are exclusively authorised to collect and use personal data. The employees are trained in data protection law and are obliged to maintain data secrecy.
The newsletter is sent by e-mail via the companies Newsletter2Go or MailChimp.
LOWA Footscan 360° stores the results of the foot measurement with the company netvico GmbH.

e) Transmission to third countries
Only in the case of sending newsletters via MailChimp, a newsletter dispatch platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. Further information: lowa.com/legal/data-protection-clause

f) Duration of storage
We store the data collected for contract processing until the expiry of the statutory or possible contractual warranty and guarantee rights. After expiry of these periods, we retain the information required under commercial and tax law for the contractual relationship for the legally specified periods of Art. 6 para. 1 lit. c) GDPR. For this period, the data will only be processed again in the event of a review by the tax authorities.

g) Rights of data subjects
According to Art. 15 - 21 GDPR, you have the following rights as a data subject:

Right to information about your personal data stored by us.
Right to rectification of incorrect or completion of your data.
Right to erasure of your data stored by us, if permissible.
Right to restriction of processing of your data, if statutory retention periods exist.
Right to object to processing. Under the conditions of Article 21(1) GDPR, processing may be objected to on grounds relating to the particular situation of the data subject pursuant to Article 6(1)(e) or (f).
If applicable, right to data portability, i.e. to receive your stored data in a structured format (from 25 May 2018).

h) Right to lodge a complaint with the supervisory authority

i) Obligation to provide personal data
The provision of personal data of data subjects is particularly essential for the initiation or execution of business interests.
Without the provision of this data, the controller cannot provide any contractual or other services.

DUTY TO PROVIDE INFORMATION - COMPETITIONS

Organising competitions - information in accordance with Art. 13 of the General Data Protection Regulation (GDPR)

Participation in competitions requires the collection of personal data (surname, first name, address, age).

We derive the authorisation to collect, store and transmit personal data from the following articles of the GDPR

  • Art. 6, para. 1 lit. a) - Consent to data processing, Art. 6, para. 1 lit. b)
  • Fulfilment of contracts Art. 6, para. 1 lit. c)
  • Fulfilment of a legal obligation

Your personal data will be stored exclusively for the purposes of the competition and not for any other purposes, unless you have consented to the use of the data for the purposes of self-promotion by post or e-mail.

Your personal data will be deleted within 2 months of the end of the competition, unless you have given your consent for the purposes of self-promotion and stored until cancellation by the recipient.

Your data will only be transmitted to third parties if this is necessary for the realisation of the competition (e.g. web agencies). Your data will not be transferred to other third parties. Necessary contracts for order data processing have been concluded.

Furthermore, your data will be transmitted to internal departments involved in the execution of the respective processes, e.g. bookkeeping, accounting, marketing, IT. As soon as the business purpose of organising the competition has been fulfilled and you have not been determined as the winner, we will delete your data within two months of the end of the competition.

However, winners are subject to retention periods under tax and commercial law. These are 10 years for accounting documents in accordance with Section 147 (1) of the German Fiscal Code (AO) and 6 years for business documents in accordance with Section 257 (1) of the German Commercial Code (HGB).

Voluntary registration for the newsletter or postal information has no influence on the chances of winning.

The first names, surnames and e-mail addresses of participants who have also registered for a newsletter as part of their participation in the competition will be used exclusively for sending the above-mentioned newsletter and stored until the recipient cancels their registration.

The cancellation can be made via the unsubscribe link at the bottom of the newsletter or in the form of an informal written message to datenschutz@lowa.de.
